Terms and Conditions of Sale

SALES TAX is extra where applicable.
TERMS OF PAYMENT are net 30 days.
MINIMUM INVOICE CHARGE is $100.00 net for any single order.
SHIPPING TERMS: F.O.B. Shipping Point (our option), Freight prepaid and allowed on single orders having a list price value of $5,000 and over, for shipment at one time to distributors warehouse. Freight Collect on single orders less than $5,000.
ROUTING: The most economical routing to recognized delivery points will be used at our discretion. If special routing is desired, order should so state.
SHIPMENT DATE: We accept your order subject to the approval of our Credit Department and contingent upon strikes, accidents and causes beyond our control and to the conditions hereafter set out. All promises of shipment are estimated as closely as possible. We use our best effort in every case to ship within the time promised but cannot guarantee to do so.
SHORTAGES: All material is carefully examined, counted and packed by experienced employees. Claims for corrections must be made within 10 days of receipt of goods. We prove our count by weight. Claims for shortages are subject to the test.
SHIPPING LOST DAMAGE OR DELAY: Carriers are responsible for goods lost, damaged or delayed in transit. For your own protection, have transportation company's agent verify damages, shortages or delays and note them on freight over his signature. Our responsibility ceases when goods are delivered to carrier in good condition and its receipt obtained.
CANCELLATIONS: Orders accepted cannot be countermanded without our written consent. Orders for non-standard material cannot be cancelled.
MATERIAL RETURNS: Material returned to Victaulic will be accepted only if clearly marked with a "Return Material Authorization" (RMA) number. Credit will be offered only on product that can be made resalable, and will be less 35% restocking charge, refurbishing costs and original freight paid. Non-standard material may not be returned for credit.

WARRANTY

"All products manufactured by Victaulic are warranted to be free from defects in materials and workmanship, provided they are used for purpose and under the conditions recommended by Victaulic, and installed in accordance with the best practices of the trade Victaulic's obligation under this warranty is limited to the replacement at its factory of any product which shall within one year after delivery to original purchaser by returned with transportation charges prepaid and which Victaulic's examination shows to have been defective. Under no circumstances shall Victaulic be liable for consequential, incidental or other damage as the result of the purchase resale or use of any of its products. This warranty is expressly made in lieu of all other warranties, expressed or implied, including the warranties of merchantability and fitness for use."
